These Terms govern your use of Rooted Health's website and member portal and your enrollment in a direct primary care ("DPC") membership with Rooted Health Hormones & MedSpa, LLC.
1. Not insurance
Membership is a direct primary care arrangement under Ark. Code § 23-99-103 and is not health insurance. It does not satisfy any individual or employer mandate, does not cover hospitalization, surgery, imaging, ER, or specialty care, and is not subject to the Arkansas Insurance Code. You are strongly advised to maintain catastrophic or major-medical coverage.
2. Eligibility & geographic scope
You must be 18+ (or have a parent/guardian sign for a minor) and physically located in Arkansas at the time of any telehealth visit. We do not establish a provider-patient relationship until enrollment is complete and an initial visit (or asynchronous review where clinically appropriate) is conducted.
3. Membership fees, billing, and term
- Monthly fees are charged in advance via Stripe.
- One-time enrollment fees are non-refundable.
- Initial term is 12 months. Cancellation requires 30 days' written notice. A $150 early-cancellation fee applies if cancellation is effective before completion of the initial 12-month term.
- Failed payments suspend non-emergency services after a 10-day grace period.
4. Add-on services
Labs, hormone therapy, peptides, GLP-1 medications, IV therapy, and aesthetic services are billed separately at member rates and are subject to clinical appropriateness. Medications requiring DEA scheduling follow federal (Ryan Haight Act) and Arkansas controlled-substance rules and may require an in-person evaluation.
5. No guarantee of outcomes
Medicine is not an exact science. We make no warranties, express or implied, regarding outcomes. Informed-consent documents describe risks and alternatives for each service.
6. Emergencies
Rooted Health does not provide emergency care. Call 911 or go to the nearest emergency department for urgent or life-threatening conditions.
7. Acceptable use
You will not misuse the portal, attempt to access another patient's data, share login credentials, or upload malicious content. We may suspend access for security violations.
8. Limitation of liability
To the fullest extent permitted by Arkansas law, Rooted Health's aggregate liability for non-clinical claims arising out of the website or portal is limited to the membership fees you paid in the 12 months preceding the claim. Nothing in these Terms limits liability for clinical malpractice, gross negligence, willful misconduct, or any liability that cannot be limited by law. Clinical care is governed by the applicable Arkansas standard of care; the statute of limitations for medical-injury actions is generally two years (Ark. Code § 16-114-203).
9. Dispute resolution
These Terms are governed by Arkansas law. The parties first will attempt good-faith resolution; thereafter, disputes will be resolved exclusively in the state or federal courts located in Faulkner County, Arkansas, except for small-claims matters and equitable relief. Nothing here waives a patient's right to bring a medical-injury action under Arkansas law.
10. Changes
We will provide at least 30 days' notice of material changes to fees or terms.
